Please read these Terms and Conditions ("Terms") carefully before using the Poke Valuations mobile application (the "App") operated by Circulaire ("we," "our," or "us"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree with any part of these Terms, do not use the App.
Poke Valuations is a mobile application that allows users to scan or photograph Pokemon trading cards and receive estimated market valuations. The App offers both a free tier (with limited valuations per month) and a paid Pro subscription with additional features including unlimited valuations, full collection tracking, and detailed market analysis.
Poke Valuations offers the following subscription plans:
All subscriptions are billed through your Apple ID account via the App Store. Subscriptions automatically renew at the end of each billing period unless canceled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the rate of the selected plan.
If a free trial is offered, the unused portion of any free trial period will be forfeited when you purchase a subscription.
You may manage or cancel your subscription at any time through your Apple ID account settings or the App Store. Cancellation takes effect at the end of the current billing period. No refunds will be provided for the unused portion of a subscription term. For refund requests, please contact Apple Support directly.
Subscription prices may change from time to time. Any price change will take effect at the start of the next subscription period following the date of the price change. Your continued use of the App after a price change constitutes your agreement to the new price.
The valuations provided by Poke Valuations are estimates based on available market data, card condition assessments, and algorithmic analysis. These valuations:
We make reasonable efforts to provide accurate valuations, but we do not warrant or guarantee the accuracy, completeness, or reliability of any valuation. You acknowledge and agree that you use valuations at your own discretion and risk.
You agree to use the App only for its intended purpose and in compliance with all applicable laws. You must not:
All content, features, and functionality of the App — including but not limited to the software, design, text, graphics, logos, and valuation algorithms — are the property of Circulaire and are protected by applicable intellectual property laws.
Pokemon, Pokemon card names, artwork, and related trademarks are the property of The Pokemon Company, Nintendo, and their respective licensors. Poke Valuations is an independent application and is not affiliated with, endorsed by, or sponsored by The Pokemon Company, Nintendo, or any related entities.
You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes in accordance with these Terms.
When you scan or upload card images through the App, you retain ownership of those images. By submitting images for valuation, you grant us a limited, non-exclusive license to process those images solely for the purpose of providing you with a valuation result.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT VALUATIONS WILL BE ACCURATE, COMPLETE, OR CURRENT.
You agree to indemnify, defend, and hold harmless Circulaire and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising out of or related to your use of the App or violation of these Terms.
We reserve the right to modify, suspend, or discontinue the App or any feature at any time without prior notice. We may update these Terms from time to time. The updated Terms will be indicated by an updated "Last Updated" date. Your continued use of the App after any modifications to these Terms constitutes your acceptance of the revised Terms.
We reserve the right to suspend or terminate your access to the App at any time, with or without cause or notice. Upon termination, your right to use the App will cease immediately. Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, limitations of liability, and indemnification.
These Terms shall be governed by and construed in accordance with the laws of Sweden, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Sweden.
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Circulaire regarding your use of the App and supersede any prior agreements.
